ACKNOWLEDGEMENT OF RISK AND RELEASE

By participating in the services and activities provided by Katmai Air, LLC (Kulik Lodge), I hereby acknowledge the following risks and responsibilities.

I acknowledge that my participation in Kulik Lodge’s services and activities are potentially dangerous or hazardous, and could entail both known and unanticipated risks, any or all of which may result in bodily and/or emotional injury, including death, to myself and/or to third persons, and possible damage to property belonging to me, Kulik Lodge and/or third parties.

Among the other risks and hazards to which I might be exposed, I acknowledge that these risks could include, without limitation:

• Flights in small planes in confined spaces to remote locations;
• Transportation by small boats in open water, rivers and streams;
• Wading, fishing or hiking along wilderness rivers, streams and other waterbodies;
• Proximity to bears and other wild animals;
• Environments that are rugged, remote and not regularly patrolled;
• Weather that is unpredictable and potentially severe;
• Sportfishing and other wilderness recreational activities that are inherently dangerous;
• Proximity to boat motors, airplanes, fishing tackle, knives and other potentially hazardous equipment;
• Injuries, illnesses (including COVID-19), hypothermia and drowning;
• Communication systems that may be intermittent, malfunctioning or non-existent; and
• Emergency medical help that may not be immediately available.

I CERTIFY THAT I AM FULLY CAPABLE OF PARTICIPATING IN THE SERVICES AND ACTIVITIES KNOWING AND UNDERSTANDING THE CONDITIONS, RISKS AND HAZARDS LISTED ABOVE.

I CERTIFY THAT I HAVE NO KNOWN MEDICAL OR PHYSICAL CONDITIONS THAT COULD INTERFERE WITH ME SAFELY PARTICIPATING IN THESE ACTIVITIES, AND AGREE TO ASSUME ALL COSTS THAT MAY DIRECTLY OR INDIRECTLY RESULT FROM ANY KNOWN OR UNKNOWN MEDICAL OR PHYSICAL CONDITION THAT I MAY HAVE.

I ASSUME FULL RESPONSIBILITY FOR MYSELF AND ANY MINORS FOR THE RISK OF BODILY INJURY, DEATH, LOSS OF PROPERTY (INCLUDING MY OWN PERSONAL PROPERTY AND THAT OF KULIK LODGE), AND ANY EXPENSES INCURRED (INCLUDING RESCUE OR RECOVERY EXPENSES) THAT RESULT FROM THE INHERENT RISKS AND DANGERS THAT I MAY BE EXPOSED TO OR DUE TO NEGLIGENCE. I AGREE TO RELEASE, WAIVE AND INDEMNIFY KULIK LODGE FROM ALL LIABILITY FOR ANY AND ALL LOSS OR DAMAGE ON ACCOUNT OF INJURY TO MYSELF, MY MINORS OR MY PROPERTY, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE WHILE PARTICIPATING IN THE SERVICES AND ACTIVITIES PROVIDED BY KULIK LODGE.

I ACKNOWLEDGE THAT I READ THIS ENTIRE DOCUMENT, UNDERSTAND IT AND ACCEPT ITS TERMS. I FURTHER AGREE THAT THIS ACKNOWLEDGEMENT OF RISK AND RELEASE ARE BINDING ON MY HEIRS, SUCCESSORS AND ANY CURRENT OR FUTURE PERSONAL OR LEGAL REPRESENTATIVES OF MY ESTATE. IF ANY PORTION OF THIS ACKNOWLEDGEMENT OF RISK AND RELEASE ARE HELD INVALID, IT IS AGREED THAT THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT. THIS DOCUMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF ALASKA.

I ALSO ACKNOWLEDGE THAT I HAVE RECEIVED, READ AND AGREE TO ABIDE BY THE REQUIREMENTS OF THE KULIK LODGE COVID-19 CLIENT PROTECTIVE PLAN.

ACKNOWLEDGEMENT OF RISK AND RELEASE ON BEHALF OF MINORS

(Must be completed for participants under the age of 18)

On behalf of the minor children for whom I am responsible (Minors), and in consideration for these Minors being permitted by Katmai Air, LLC (Kulik Lodge) to participate in the services and activities provided by Kulik Lodge and to use Kulik Lodge equipment and facilities, I agree that all of the terms of the “Acknowledgement of Risk and Waiver” (Acknowledgement) are incorporated herein and shall apply to the Minors, and that the Minors, including the Minors’ parents, guardians, heirs, successors, personal or legal representatives, and anyone else acting by or on behalf of the Minors, are bound by all of the terms of the Acknowledgement.

By clicking ACCEPT below, I certify that I have discussed the risks of these services and activities with the Minors and have explained to the Minors the meaning of the Acknowledgement, and that I have the authority to sign the Acknowledgement on behalf of the Minors and their parents, guardians, heirs, successors, personal and legal representatives, and anyone else acting by or on behalf of the Minors.
